This HIPAA Notice of Privacy Practices (the “Notice”) explains how we may use and disclose your Protected Health Information (“PHI”), and your rights concerning that information. ETS is considered a “covered entity” under 45 C.F.R. Parts 160 and 164.

  • Receive a list of disclosures showing who has received your information, other than for treatment, payment, or operations.
  • Receive a paper copy of this Notice at any time, even if you’ve agreed to receive it electronically.
  • File a complaint if you believe your privacy rights have been violated (instructions below).

How We Use and Share Your Information

Ark Provision may use or disclose your PHI in the following ways:

1. For Treatment

We use and share your information with healthcare professionals involved in your care, such as your therapist, physician, or behavioral analyst, to coordinate and provide quality services.

2. For Payment

We may use and share your information with your insurance provider or payer to verify benefits, obtain authorization, and process claims for services you receive.

3. For Healthcare Operations

We may use your information to evaluate and improve our services, conduct quality assessments, train staff, or manage our practice.

Other Permitted and Required Uses

  • When required by law or court order.
  • For public health and safety purposes (e.g., preventing abuse or neglect).
  • To comply with government oversight (e.g., audits, inspections).
  • To comply with workers’ compensation or similar programs.
  • To prevent or lessen a serious and imminent threat to health or safety.
  • To coroners, medical examiners, or funeral directors as required.
  • For research purposes, only with appropriate authorization and privacy safeguards.

We will never share your PHI for marketing, fundraising, or sale of information without your written permission.

Uses Requiring Your Written Authorization

Other uses or disclosures not described in this Notice will be made only with your written authorization. You may revoke that authorization at any time, in writing.

Our Responsibilities

  • Maintain the privacy and security of your PHI.
  • Notify you promptly if a breach occurs that may have compromised the privacy or security of your information.
  • Follow the terms of this Notice currently in effect.
  • Provide you with this Notice explaining our legal duties and privacy practices.

Your Choices

You may choose how we share certain information, such as:

  • Sharing information with family members or caregivers involved in your care.
  • Including your name or photo in internal educational or promotional materials (only with consent).
  • Communicating via email or text — these methods may not always be fully secure, and we will only use them with your permission.

Ark Provision reserves the right to update or revise this Notice at any time. Any updates will be posted on our website and made available in our office. The revised Notice will apply to all PHI we maintain.
